Oregon State Police (OSP) is continuing the investigation into the death of a 45-year old Gresham man Tuesday night after he reportedly fell out of the passenger side door of a pickup traveling on Highway 240 west of Newberg.

According to Lieutenant Eric Davenport, on August 13, 2013 at approximately 8:09 p.m., a Toyota Tundra pickup driven by PHILLIP LOCKWOOD, age 42, from Newberg, was traveling westbound on Highway 240 just east of NE Ribbon Ridge Road near milepost 6. The lone passenger in the pickup with LOCKWOOD was a friend identified as RONALD LOREN TOBY, age 45, from Gresham.

As the pickup traveled westbound at approximately 55 mph, LOCKWOOD reported the passenger door suddenly opened and TOBY fell out onto the roadway.

Emergency responders from Newberg Fire Department, Yamhill County Sheriff's Office and OSP responded to the scene and confirmed TOBY was deceased from injuries sustained after landing on the roadway.

OSP troopers from the McMinnville Area Command office are continuing the investigation. Preliminary information indicates alcohol may have been a contributing factor for TOBY. He was not using safety restraints.

ODOT assisted at the scene. The highway was closed for about three hours during the investigation.

No photographs to be released.
